LAW OF EVIDENCE
PAPER I

नोट: किन्हीं पाँच प्रश्नों के उत्तर दीजिये। सभी प्रश्नों के अंक समान हैं। दृष्टि बाधित परीक्षार्थियों के लिये 60 मिनिट अतिरिक्त समय की अनुमति है।

 Answer any five questions. All questions carry equal marks. The blind candidates will be given 60 minutes extra time.

1. संस्वीकृति सम्बन्धी विधि का वर्णन कीजिये। यह स्वीकृति से किस तरह भिन्न है? उन परिस्थितियों का वर्णन कीजिये, जिनमें एक पुलिस अधिकारी के समक्ष दी गई संस्वीकृति साक्ष्य में ग्राह्य होती है। 

State the law relating to confession. How it differ from an admission? When a confession made before police officer become admissible in Evidence ?

2. मृत्युकालिक घोषणा से आप क्या समझते हैं? उन परिस्थितियों का वर्णन कीजिये, जिनसे मृत्युकालिक घोषणा साक्ष्य में ग्राह्य होती है।

 What do you mean by Dying Declaration? State the circumstances under which a dying declaration in admissible in Evidence.

3. सबूत के भार से आप क्या समझते हैं? एक दावा या कार्यवाही में सबूत के भार के विनिश्चय सम्बन्धी नियमों का उल्लेख कीजिये। 

What do you understand by Burden of Proof? State the rules of determining Burden of Proof in a suit or proceeding.

4. साक्ष्य शब्द की परिभाषा देते हुये यह बताइये कि क्या उसमें शपथ पत्र सम्मिलित है?

 Define the term Evidence and state whether an affidavit is included there in ?

5. सूचक प्रश्न किसे कहते हैं? यह कब पूछा जा सकता है तथा कब नहीं पूछा जा सकता है? पूर्ण विवेचना कीजये । What is a leading question? When it can and when it cannot be asked? Discuss fully.

6. विबंधन के सिद्धान्त को समझाइये। विबन्धन कितने प्रकार के होते हैं? क्या विबन्धन अव्यस्कों पर लागू होता है ?

 Explain the doctrine of estopel. What are its kinds? Does it apply to Minors?

7. 'विशेषज्ञ' किसे कहते हैं? उसका मतलब कब सुसंगत होता है? उदाहरण सहित विवेचना कीजिये ।

 Who is an 'Expert'? When is his opinion relevant? Explain with illustrations.

8. किसी साक्षी के मौखिक परीक्षण की विभिन्न स्थितियों का वर्णन करते हुये यह स्पष्ट कीजिये कि कब साक्षी को प्रस्तुत करने वाला पक्ष उसका प्रति परीक्षण कर सकता है? 

Describe the different stages in testimony of a witness and show whether and when a person producing can cross examine the witness?

9. 'रेस-जेस्टे' के सिद्धान्त का उदाहरण सहित पूर्ण विवेचन कीजिये। क्या आप इस मत से सहमत हैं कि रेस जेस्टे केवल बेकार ही नहीं वरन सचमुच हानिकारक भी है ?

Discuss fully the doctrine of 'Res-gestae' and give examples. Do you agree with the view that Res-gestae is not entirely unless but even positively harmful?

10. सह-अपराधी कौन होता है? क्या वह सक्षम साक्षी है? उसके साक्ष्य की महत्ता बताइये । 

Who is an accomplice? Is he competent witness? State the value of his evidence.
